Hemp flower is not marijuana. However, is CBD hemp flower with less than 0.2% THC legal? No, unless it qualifies as an “exempted product” under Regulation 2 of the MDR 2001. To meet this exemption, CBD hemp flower or hash must satisfy three key criteria:
(a) The product must not be designed for administering the controlled drug to humans or animals.
Compliance: Our tea is specifically intended to be infused in hot water and consumed as a beverage. It is not designed for administering any controlled substances.
(b) The controlled drug must be packaged in a way that prevents recovery by simple means and poses no health risk.
