The Law:
Hemp flower is not marijuana. However, is CBD hemp flower with less than 0.2% THC legal? No, unless it qualifies as an “exempted product” under Regulation 2 of the MDR 2001. To meet this exemption, CBD hemp flower or hash must satisfy three key criteria:

(a) The product must not be designed for administering the controlled drug to humans or animals.

(b) The controlled drug must be packaged in a way that prevents recovery by simple means and poses no health risk.
Compliance: The cannabinoids in our tea are not water-soluble and cannot be effectively extracted during the infusion process. This ensures they cannot be recovered by straightforward methods and pose no health risk.

(c) No component of the product may contain more than one milligram of the controlled drug.
Compliance: Each serving of our tea (weighing less than 0.5g) contains under 1mg of Δ9-THC, staying well within the legal limit for controlled substances.
